Called “Good Samaritan Accidents,” these particular motor vehicle collisions occur as the result of a driver being involved in an accident after receiving a wave or another signal from another motorist. Presumably, a wave or gentle honk at an intersection means a driver is ceding his/her right-of-way and allowing another driver to proceed.
Massachusetts courts have ruled that signaling motorists can be held liable if their wave or signal leads to an accident. In Gennelly v. Leslie, the defendant claimed that their signal was intended to inform the other driver that they wouldn’t be hit by the defendant, not that the highway itself was safe to cross.
Blind spots, four-way intersections, and multi-lane highways are problem areas for Good Samaritan Accidents. But in reality, this problem could happen anywhere there are cars, buses, pedestrians, and bicyclists.

Driver in Hit-and-Run Death of Seattle Student Pleads Guilty
A 64-year old woman in Poughkeepsie, New York has plead guilty in the hit-and-run deaths of two college students, one of whom was from Seattle. According to police, Carol Boeck of Red Hook struck Sarah McCausland of Winnetka, Illinois and Evelina Brown of Seattle when they were walking with a third student along Route 9G in Tivoli on January 31, 2014.
Boeck faces up to 21 years in prison.
Cold Weather Affects Drivers in New York
New York State Police report that a two-car accident sent one driver to the hospital after another driver attempted to pass her vehicle on winter roads. The driver, Cory Romeyn of Gabriels, attempted to pass Kimberly Snyder of Bloomingdale and lost control of his vehicle. His pickup struck the driver’s side of Snyder’s sedan and sent both vehicles spinning. Snyder’s car struck a snow bank and stopped against a steel guide rail.
Snyder was taken to a medical center in Saranac Lake, reporting pain in her neck and back. Romeyn was not hurt and was ticketed for speeding.

Scenario: You’re approaching an intersection in your vehicle, and the intersection does not have a traffic light, stop sign, or any other light or sign to control traffic. You notice that one or two other vehicles are traveling at about the same speed as you are, and you will probably reach the intersection at the same time. What should you do to follow traffic laws?
This is what is called an ‘uncontrolled intersection.’ According to Washington State law, “When two vehicles approach or enter an intersection from different highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.” (RCW 46.61.180).
If you and another driver are approaching the uncontrolled intersection at about the same time and the other driver is on your right, he or she has the right of way and you should legally yield to that driver.
Conversely, if the other vehicle is on your left when you and the other driver enter the intersection, you have the right-of-way. However, under the law, both drivers have a duty to exercise due care, so it’s always a good rule of thumb to slow down as you enter the intersection and check for approaching vehicles to reduce your risk of collision.
